UPDATE: Supreme Court Decision

On June 28, 2012 Chief Justice John Roberts, writing for the majority, stated that the individual mandate was constitutional, not under Congress’ power to regulate commerce but to tax (Article 1 Sec. 8).  Listen to the audio of the decision below.
